These Terms of Service ("Terms") are a legal agreement between you and Homestead Enterprises LLC ("VulcanTunes", "we", "us", or "our") governing your access to and use of this website and your purchase of our products. By using this site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site or purchase from us.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to enter a binding contract to purchase from us. By ordering, you represent that you meet these requirements and that the information you provide is accurate and complete.

2. Our products & fitment

We sell audio adapters and accessories designed for specific Kawasaki Vulcan motorcycles (including Voyager and Vaquero models). Fitment depends on your motorcycle's year and model. You are responsible for confirming that a product fits your bike before ordering — please use the fitment options at checkout, the product information, and our on-site assistant. We are not responsible for products ordered for an incompatible vehicle where correct fitment information was available.

3. Orders & acceptance

Your order is an offer to buy. We may accept, decline, limit, or cancel any order for any lawful reason — including product availability, suspected fraud, or errors in pricing or product information — even after you receive an order confirmation. If we cancel an order you have paid for, we will refund the amount charged. We may correct obvious pricing or description errors and cancel affected orders.

4. Pricing & payment

Prices are shown in U.S. dollars and may change at any time before you order. You are responsible for any applicable taxes and duties. Payment is processed securely by our third-party payment providers (which may include Stripe, PayPal, and Square); by paying, you authorize the charge and confirm you are permitted to use the payment method. We do not store full payment card numbers.

5. Shipping & delivery

Shipping options, timing, and costs are described at checkout and in our Shipping Policy. Delivery estimates are not guarantees. You are responsible for providing a correct, complete shipping address; we are not liable for delays or non-delivery caused by an incorrect address. Risk of loss passes to you when the carrier takes possession of your order.

6. Returns, refunds & RMA

Returns are handled per our Returns & RMA policy. Please review it before purchasing; some items or conditions may not be eligible for return.

7. Installation, use & safety

You are responsible for the proper and safe installation and use of our products, including following any included instructions and having installation performed by a qualified person where appropriate. Do not operate audio, a phone, or navigation in a way that distracts you from riding, and comply with all applicable traffic and helmet/audio laws in your area. We are not responsible for damage, injury, or loss resulting from improper installation, misuse, or unsafe operation.

8. Warranty & disclaimer

Any limited warranty we offer is described at the time of sale or on the product page. Except for such express warranty and any rights you have under applicable law, our products and this site are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. On-site AI assistant

Our website may offer an AI assistant to answer product questions. Its responses are for general information only, may be incomplete or inaccurate, and are not professional, legal, or safety advice. Do not enter sensitive personal or payment information in the chat, and confirm important details (such as fitment and price) before relying on them. Your use of the assistant is subject to these Terms and our Privacy Policy.

10. Acceptable use

You agree not to misuse the site, including: attempting to breach security; scraping, spamming, or submitting false information through our forms; interfering with the site's operation; using it for any unlawful purpose; or infringing others' rights. We may suspend or terminate access for violations.

11. Intellectual property

The site and its content — including text, graphics, logos, product images, and the VulcanTunes name and marks — are owned by us or our licensors and protected by law. You may not copy, reproduce, or use them without our written permission, except as needed to browse and purchase for personal use.

12. Third-party services

We rely on third-party services (for example, payment processing, shipping and label generation, address validation, bot protection, email delivery, and the AI assistant). Your use of those features may be subject to the third parties' own terms and privacy practices, and we are not responsible for their services.

13. Limitation of liability

To the fullest extent permitted by law, VulcanTunes and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or products. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some may not apply to you.

14. Indemnification

You agree to indemnify and hold VulcanTunes harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the site or products, or your violation of any law or the rights of others.

15. Governing law & disputes

These Terms are governed by the laws of the United States and the state in which VulcanTunes operates, without regard to conflict-of-laws rules. You agree that any dispute will be handled in the courts located in that state, and you consent to their jurisdiction, except where applicable law provides otherwise.

16. Changes to these Terms

We may update these Terms from time to time; the "last updated" date above reflects the current version. Your continued use of the site or a new purchase after changes take effect constitutes acceptance of the updated Terms.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our policies referenced here, are the entire agreement between you and us regarding the site and your purchases.
